By accessing or using our website and services, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use our platform. 1. Acceptance of Terms

These Terms form a legal agreement between you (“User,” including individuals, businesses, or organizations) and Indigenous Business Directory (“we,” “us,” or “our”). Using our services, including job postings ($100/month), business listings ($60/month or $612/year), and event postings ($45/month), constitutes acceptance of these Terms, our Privacy Policy, and other linked policies.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter agreements to use our services. By using our platform, you represent that you meet these requirements.

3. Services Provided

We offer a directory to promote Indigenous-owned businesses, jobs, and events:

Job Postings: Post job openings for 30 days at $100.

Business Listings: List your business for $60/month or $612/year (15% savings).

Event Postings: Promote events for 30 days at $45.

We reserve the right to modify, suspend, or discontinue services at any time, with or without notice.

4. User Responsibilities

You agree to:

Provide accurate, complete, and lawful information for all listings, job posts, and event submissions.

Maintain the confidentiality of your account credentials and notify us immediately of unauthorized access.

Comply with all applicable laws, including those related to advertising, employment, and event promotion.

Obtain necessary permissions for any content you submit (e.g., images, logos).

5. Acceptable Use

You may not:

Post false, misleading, or fraudulent information.

Submit content that is defamatory, obscene, discriminatory, or violates intellectual property rights.

Use automated tools (e.g., bots, scrapers) to access or collect data from our platform.

Interfere with the platform’s functionality (e.g., hacking, spreading malware).

Use our services for illegal activities or to harm others.

We may remove content or suspend accounts for violations at our discretion.

6. Payment Terms

Fees: You agree to pay for services as listed ($100 for job postings, $60/month or $612/year for business listings, $45 for event postings).

Billing: Payments are processed via secure third-party providers (e.g., Stripe, PayPal). Monthly subscriptions do not renew automatically.

Non-Refundable: Fees are non-refundable except as outlined in our Refund Policy.

Failed Payments: We may suspend listings or accounts for failed payments after reasonable notice.

7. Intellectual Property

Our Content: All site content (e.g., logos, design, text) is owned by Adobe Outlet or its licensors and protected by copyright and trademark laws. You may not use it without permission.

Your Content: By submitting content (e.g., listings, images), you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute it on our platform to promote your business, job, or event. You retain ownership of your content.

8. Content Moderation

We may review, edit, or remove user-submitted content (e.g., listings, job posts, events) to ensure compliance with these Terms or maintain platform quality. You may appeal removals by contacting support@adobeoutlet.com.

9. Termination

By You: You may stop using our services or cancel your account at any time. No refunds are issued for unused periods unless specified in our Refund Policy.

By Us: We may suspend or terminate your account or access for violating these Terms, non-payment, or other reasons at our discretion, with or without notice.

Effect of Termination: Upon termination, your listings will be removed, but publicly posted content may remain in archives or third-party search engines.

10. Limitation of Liability

To the fullest extent permitted by law:

Our services are provided “as is” without warranties of any kind, express or implied.

We are not liable for any damages (e.g., direct, indirect, incidental) arising from your use of our platform, including inaccuracies in listings, service interruptions, or third-party actions.

Our total liability shall not exceed the fees you paid us in the past 12 months.

11. Indemnification

You agree to indemnify and hold Adobe Outlet, its affiliates, and employees harmless from any claims, losses, or damages arising from your use of our services, content, or violation of these Terms.

12. Third-Party Links

Our platform may include links to external sites (e.g., business websites, social media). We are not responsible for their content, practices, or availability.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Mexico, United States
